Ethics: Legal Representation in Cross-Cultural Contexts
Mr Robert Blowes SC, Barrister, Blackburn Chambers
Lawyers need to guard and be informed against any assumption that all clients may be regarded and represented in the same way.
Whilst all are equal, they are not the same and any assumption to the contrary may result in a failure to adequately represent a client.
The ways in which clients differ in their cultures and first language may have profound implications for adequate representation and protection of their interests.
Even their ‘interests’ may not fit into neat legal categories with which a practising lawyer is familiar.
The presenter will deal with such issues from the perspective of long experience in dealing with indigenous Australian clients in group contexts. |
